These Terms of Service (“Terms”) govern your access to and use of the website, services, content, and any related products or communications provided by Morning Moon Digital Media, LLC (“Company,” “we,” “us,” or “our”). By visiting our website or purchasing/using our services, you agree to these Terms.

1) Who We Are

Morning Moon Digital Media, LLC provides digital services and coaching, which may include (depending on what you purchase): website design and builds, brand and marketing support, content strategy, consulting, coaching, templates, digital products, and related offerings (“Services”).

2) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use this site and purchase Services.

3) Use of the Website

You agree not to:

  • Use the site for unlawful purposes

  • Attempt to hack, disrupt, scrape, or reverse engineer anything

  • Upload or transmit viruses or malicious code

  • Misrepresent your identity or impersonate others

  • Copy, resell, or exploit any portion of the site or content without written permission

We can refuse service, suspend access, or remove content at our discretion if we believe you are violating these Terms.

4) Accounts and Communications

If you create an account or submit forms, you agree to provide accurate information and keep it updated. You also agree we may contact you via email, phone, or text (if you provide a number) regarding your inquiries, purchases, or service updates. Message and data rates may apply.

5) Purchases, Payments, and Billing

If you purchase Services, you agree:

  • You are authorized to use the payment method provided

  • You will pay all fees listed at checkout or in your proposal/invoice

  • Prices may change at any time for future purchases (not retroactive)

We may use third-party payment processors (for example: Stripe, PayPal, Squarespace Payments). Your payment details are handled by those processors under their own terms.

6) Refunds and Cancellations

Because Morning Moon Digital Media may offer custom work, coaching, and digital products, refunds depend on what you purchased and what work has begun.

Unless a separate written agreement says otherwise:

  • Digital products, templates, downloads, and trainings are non-refundable once access is delivered.

  • Coaching sessions may be rescheduled with reasonable notice (typically at least 24 hours). No-shows or late cancellations may be forfeited.

  • Custom services (websites, branding, DFY work, consulting) are generally non-refundable once work begins due to time allocation and project planning.

If you purchased through a proposal or contract with a specific refund/cancellation policy, that written agreement controls.

7) Project Timelines and Client Responsibilities (For DFY/Custom Work)

For custom projects, you agree to provide materials, feedback, approvals, and access (logins, assets, copy, etc.) in a timely manner. Delays on your side can delay timelines and may require rescheduling, re-quoting, or additional fees.

8) Intellectual Property

All content on this site (text, graphics, logos, videos, templates, and trainings) is owned by Morning Moon Digital Media, LLC or properly licensed. You may not copy, reproduce, distribute, or create derivative works without written permission.

If you purchase a deliverable (example: a website build or brand assets), you receive a license to use what you paid for, for your business use, unless otherwise stated in writing. We retain rights to our underlying processes, frameworks, templates, and any pre-existing materials we bring to the project.

9) User Content and Testimonials

If you submit reviews, testimonials, comments, images, or other content, you grant us permission to use them for marketing and business purposes unless you specifically revoke that permission in writing. We may edit for clarity or length while preserving the original meaning.

10) Educational and Coaching Disclaimer

We may provide coaching, strategy, and education. You understand:

  • Results are not guaranteed

  • Your outcomes depend on your effort, market conditions, and personal factors

  • Nothing on this website is financial, legal, or medical advice

If we discuss wellness topics, it is educational only and not medical advice. You should consult qualified professionals for medical, mental health, financial, or legal decisions.

11) Third-Party Links and Tools

We may link to third-party websites or use third-party tools (example: scheduling platforms, email platforms, analytics). We do not control those third parties and are not responsible for their content, policies, or actions.

12) Disclaimers

THE WEBSITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” We make no warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement.

13) Limitation of Liability

To the fullest extent allowed by law, Morning Moon Digital Media, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, revenue, or goodwill arising from your use of the website or Services.

If liability is found, our total liability will not exceed the amount you paid to us in the twelve (12) months before the event giving rise to the claim.

14) Indemnification

You agree to defend, indemnify, and hold us harmless from claims, damages, liabilities, and expenses (including attorneys’ fees) arising from your use of the site, your violation of these Terms, or your infringement of any rights of another.

15) Termination

We may terminate or suspend access to the site or Services at any time for any reason, including violation of these Terms.

16) Governing Law and Venue

These Terms are governed by Washington State law, without regard to conflict-of-law rules. Any disputes will be handled in the state or federal courts located in Washington, and you consent to that jurisdiction and venue.
